1 Bruce and Tracie Black, doing business as Westside Auto Center, LLC (the Blacks), have appealed from a judgment dismissing their complaint against Tim Bach. The Blacks brought this action against Bach and Kahl Construction, Inc., alleging breach of contract and negligence in the construction of a commercial building. Judgment was entered pursuant to a trial court order granting partial summary judgment and dismissing Bach from the action on the ground that Bach was acting as an agent of Kahl Construction, Inc., when contracting with the Blacks, and the Blacks were aware that he was representing the corporation. We reverse the judgment and remand the matter for further proceedings consistent with this decision.
