LAY, Circuit Judge. Muriel D. Black, after obtaining a default judgment against several of the defendants, appeals from an order of the magistrate Judge dismissing his complaint for failing to state a claim for retaliation and for denial of his rights under the Due Process Clause.*fn1 We vacate the magistrate Judge's order of dismissal and remand to the district court for further proceedings consistent with this opinion.
